This Course will explore the purpose of trade mark laws, identify the different types of marks, including names, designs, logos, and trade dress, and explore strategies for choosing and protecting strong, potentially valuable trade marks. We shall also explore the tort of passing off, and what happens when your trade marks are not yet registered. We will also discuss strategies for increasing the chances of obtaining a successful trade mark registration, and lay out the steps for filing for trade mark protection. Finally, we will touch on the basics of how to design an ongoing maintenance strategy to protect, extend, and maximize the value of trade marks, and discuss strategies for responding to possible trade mark infringement.
